1. About Expert-Ease

Expert-Ease is an upcoming education technology platform facilitating offline, personalized, one-on-one home tuition for students in Pre-Primary to Grade 8 across all boards and all major academic subjects in India and co-curricular activities for any age group. Our pedagogy emphasizes:

• Screen-Free Learning: 100% offline, face-to-face sessions with no device dependency for tuitions.
• Personalized One-Student-One-Mentor Model: Qualified tutors conduct lessons at the student's home.
• Holistic Growth: Prior to every session, there is a 10-minute yoga and meditation video to foster mindfulness.
• Affordable Tuition: High-impact learning at pricing comparable to online or group classes.
• Empowerment of Educators: Providing part-time opportunities for aspiring teachers, particularly through weekend programs.

We cater to core academic subjects and co-curricular fields, including languages, arts, and music, etc.

2. User Eligibility

Use of our platform is permitted only to:

• Parents or legal guardians (18 years or older) who can legally enter into contracts under the Indian Contract Act 1872 and allied laws.
• Tutors who are adults, possess relevant academic qualifications, and pass our verification process and skill test.
• Minors may use the service only under the direct supervision of a parent or legal guardian.

3. Account Registration and Access

• To access the full features of the platform, users must create a secure account and provide accurate personal and educational information.
• You are solely responsible for maintaining the confidentiality of login credentials provided to you on our official website.
• We reserve the right to reject, suspend, or terminate accounts that contain false information or violate these terms and conditions mentioned hereunder.

User Acknowledgements and Responsibilities

Each user of the Expert-Ease Platform hereby agrees to and acknowledges the following:

• Expert-Ease provides interactive forums for users to contribute content, including but not limited to blogs, comments, reviews, and photographs. You affirm that all content submitted by you is original, does not infringe any third-party rights, and that you hold full copyright ownership or lawful rights to publish such content.
• Information related to educational institutions or service providers displayed on the Platform is sourced from publicly available data, official websites, telephonic communication, or other third-party sources. Expert-Ease does not guarantee the accuracy, completeness, or current validity of such information.
• Expert-Ease does not act as an authority or final advisor for any user's decision-making. Any decisions made based on the Platform's content are undertaken solely at the user's own discretion, risk, and responsibility, and should be independently verified.
• Expert-Ease, at its sole and absolute discretion, reserves the right to edit, remove, or restrict access to any content, including user-generated content, without prior notice and without incurring any liability. Reasonable efforts may be made to inform users of any such actions where appropriate.
• By uploading your personal image or the logo of any associated institution, you expressly grant Expert-Ease a non-exclusive, royalty-free, worldwide, irrevocable license to use, reproduce, and display such image or logo on the Platform and across any marketing or promotional materials owned or distributed by Expert-Ease.
• If you voluntarily update or submit your contact details (such as mobile number or email address) on the Platform, Expert-Ease reserves the right to contact you via phone calls, SMS, or email communication.
• The collection, extraction, or harvesting of usernames, contact details, or email addresses from the Platform for purposes of advertisement, solicitation, spamming, or any other unauthorized use is strictly prohibited.

Prohibited Conduct

You shall not, under any circumstance:

• Attempt to probe, scan, or test the vulnerability of the Platform or breach any security or authentication feature.
• Access, retrieve, or index Platform content or services using any automated tool, bot, scraper, or third-party search engine, except as explicitly authorized.
• Create user accounts by automated means, impersonation, or through false or fraudulent representations.
• Post, upload, or display any content containing direct sales offers, commercial advertisements, or promotional materials for goods or services, unless explicitly permitted by Expert-Ease.
• Publish forged, manipulated, or misleading content, including but not limited to falsified reviews or endorsements.

Service Modification

Expert-Ease reserves the right, at any time and without prior notice, to modify, suspend, or discontinue the Platform or any part thereof, either temporarily or permanently, without incurring any liability to users or third parties.

4. Scope of Services

The platform offers the following services:

• Curated matching of students with verified tutors based on academic needs, location, and schedule.
• Expert-Ease facilitates the matching of individuals seeking co-curricular instruction with verified tutors possessing demonstrable expertise and in-depth knowledge in their respective fields.
• In-person demonstration sessions at the student's residence for a fixed nominal fee, with demo videos provided free from the official website.
• Full-time engagement with a selected tutor upon approval by the parent/ legal guardian.
• Options for easy replacement or refund in accordance with our Refund Policy.
• Tutors are independent service providers and not employees or agents of Expert-Ease.

5. Subscription & Payment Terms

• Users can choose from hourly, monthly, quarterly, half-yearly, or annual fee plans subject to change from time to time.
• All tuition fees are payable in advance following the demonstration session.
• Annual subscriptions may include concessions, such as waiver of one-month fees subject to change from time to time.
• All payments for services rendered shall be made exclusively through the official Expert-Ease website; cash-on-delivery (COD) or any form of direct payment to tutors or to any Expert-Ease employee's personal account is strictly prohibited and shall constitute a breach of the service terms.
• The Platform shall charge a platform or service fee, which shall be included in the total tuition fee communicated to the Student or Parent/Guardian. This fee shall be applicable to all billing formats, including but not limited to quarterly, half-yearly, and annual fee structures.
• The Tutor/Trainer shall be entitled to receive only the tuition fees as specified by him/her at the time of registration on the Website. Any platform fee or markup charged in addition to the tuition fees shall be retained by the Website and shall not form part of the payment due to the Tutor/Trainer.
• For quarterly, half-yearly, or annual sessions, the first payment to Tutors shall be released at the end of the first month of the session. Subsequent payments shall be made at 15 (fifteen) day intervals. A credit period of 15 (fifteen) days shall be maintained by the Platform in order to support and facilitate its refund and grievance redressal policy.
• No advance payment shall be made to any Tutor under any circumstances.
• For sessions billed on an hourly or monthly basis, the Tutor shall receive payment within 2 (two) to 3 (three) business days following successful completion of the session, subject to verification and confirmation by the Platform.
• The fee for any Demo Session, if applicable and pre-approved by the Platform, shall be paid on the same day of completion. In the event that the day of payment falls on a public or bank holiday, the payment shall be processed on the immediate next working day.
• A Full and Final Settlement of all dues shall be completed upon conclusion of the last scheduled session of the agreed-upon tuition package, subject to satisfactory compliance with all platform policies and deliverables.
• The Platform reserves the right to introduce and include a Marketing and Promotional Fee for Tutors in the future, which may be charged as part of the Platform's overall service offerings. Such a fee, if and when implemented, shall be duly communicated to all Tutors in advance and shall form part of the terms governing continued usage of the Platform. By continuing to use the Platform, Tutors agree to be bound by such revised fee structures, as may be notified from time to time.

6. Code of Conduct

All users, including parents, guardians, students, and tutors, are required to:

• Maintain respectful communication and behaviour at all times.
• Avoid any form of harassment, discriminatory conduct, or verbal abuse.
• Use the platform strictly for educational purposes.
• Refrain from engaging in private financial transactions outside the platform for services discovered through Expert-Ease.
• Tutors are expected to conduct themselves professionally, adhere to the agreed-upon schedule, and maintain student confidentiality at all times.

7. Restrictions on Use

You are expressly prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, updating, or sharing any information or content on or through the Expert-Ease Platform that:

• Belongs to any other person or entity and to which you do not have a legal right of ownership or authorized license;
• Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially or ethnically objectionable, disparaging, or otherwise unlawful in any manner whatsoever, or relates to or promotes money laundering, gambling, or any activity prohibited by law;
• Is intended to, or likely to, harm minors in any manner;
• Infringes any patent, trademark, copyright, or other proprietary rights or intellectual property rights of any third party;
• Violates any applicable law currently in force within the territory of India;
• Deceives or misleads the addressee about the origin of the message or communicates any information that is grossly offensive or menacing in nature;
• Impersonates another individual or falsely associates you with any other person or entity;
• Contains software viruses or any other computer code, files, or programs designed to disrupt, damage, disable, or limit the functionality of any computer system, software, hardware, or telecommunications equipment;
• Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order, or incites the commission of any cognizable offence, or prevents the investigation of any offence, or is insulting to any other nation.

Expert-Ease reserves the absolute right to remove, delete, or disable access to any content or information that, in its sole and unfettered discretion, is found to be in violation of any of the aforementioned conditions, without any prior notice and without incurring any liability whatsoever.

8. Intellectual Property Rights

All content on the platform—including tutor listings, articles, videos, logos, and branding—is the sole property of Expert-Ease or its licensors. Unauthorized reproduction, modification, or distribution of any content is strictly prohibited and may lead to legal action.

9. Limitation of Liability

Expert-Ease serves as an intermediary as defined under the Information Technology Act, 2000. We are not responsible for:

• Learning outcomes or compatibility between the student and the tutor.
• Any negligence, misconduct, or unlawful behaviour by third-party tutors.
• Failure or delay in services due to force majeure events (e.g., illness, natural disaster, lockdowns).

Our maximum liability shall be limited to the unutilized portion of the user's fee in dispute.

10. Limitation of Liability and Force Majeure

Expert-Ease shall not be held liable for any failure or delay in performance of its obligations under these Terms caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions or regulations, strikes, war, terrorism, civil unrest, power outages, or any other force majeure events ("Force Majeure Events").

In the occurrence of such Force Majeure Events, Expert-Ease shall be entitled to a reasonable extension of time to perform its obligations or may, at its discretion, suspend or terminate services without any liability to the User.

11. Indemnity and Independent Status of Tutors and Students

You acknowledge and agree that:

• Tutors engaged via Expert-Ease are independent contractors and not employees, agents, or legal representatives of Expert-Ease.
• Students and parents similarly act independently and are responsible for their conduct and decisions regarding engagement and interactions with tutors.
• Expert-Ease is not responsible or liable for any claims, damages, losses, costs, or expenses arising directly or indirectly from the actions, omissions, negligence, or misconduct of tutors or students.

You agree to indemnify, defend, and hold harmless Expert-Ease, its affiliates, directors, officers, employees, and agents from and against any and all claims, demands, suits, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or relating to:

• Your breach of these Terms or applicable laws;
• Any act or omission of a tutor or student, including but not limited to negligence, misconduct, or violation of applicable laws;
• Any use or misuse of the platform services or content beyond the scope agreed upon by Expert-Ease.

In the event that any teacher or tutor engaged through the Expert-Ease platform discontinues or abandons the assigned classes without prior notice, valid justification, or formal disengagement—hereinafter referred to as "ghosting"—such tutor shall forfeit any right to receive payment for the classes conducted. Expert-Ease shall have the sole discretion to determine such conduct, and any such determination shall be final and binding.

Mere registration on the Expert-Ease platform does not constitute an offer, assurance, or guarantee of class assignments or employment. The allocation of tutoring assignments is subject to verification of the tutor's credentials, background checks, demonstrated teaching capability, communication skills, subject-matter expertise, responsiveness, and overall performance, as assessed solely by Expert-Ease and/or the students or their guardians. The decision regarding assignment or denial of classes shall be final and non-contestable.

All tutors registered with the Expert-Ease platform are mandatorily required to remain reachable and responsive via their registered contact number(s) for a minimum duration of eight (8) hours during each working day, to ensure effective coordination and communication regarding class schedules and student requirements.

In the event of non-availability or failure to respond without reasonable cause on two (2) consecutive working days, Expert-Ease reserves the right to suspend the concerned tutor's registration and temporarily deactivate their profile pending a formal inquiry.

Upon conclusion of the investigation, if the tutor is found to be at fault or non-compliant with the communication obligations herein, such tutor shall be required to undergo the registration process afresh in order to be considered for re-engagement on the platform. The decision of Expert-Ease in this regard shall be final and binding.

Expert-Ease reserves the right to suspend or permanently terminate your access to the Platform, without prior notice or liability, if it is determined, at the sole and absolute discretion of the Company, that you have violated, contravened, or acted inconsistently with any provision of these Terms and Conditions or any applicable policies governing the use of the Platform. Such termination shall be effective immediately and shall not require prior communication or justification.

12. Suspension & Termination

Expert-Ease reserves the right to suspend or terminate user accounts without notice under circumstances including, but not limited to:

• Violation of these Terms or applicable law,
• Misrepresentation or fraud,
• Abuse or harassment of any staff, tutor, or other user,
• Misuse of payment systems.

Upon termination, you shall forfeit any promotional or non-refundable amounts unless eligible under our Refund Policy.

13. Dispute Resolution & Governing Law

These Terms shall be governed by the laws of India. The courts of Mumbai, Maharashtra shall have exclusive jurisdiction.

14. Amendments to Terms

Expert-Ease may revise these Terms periodically to reflect changes in our operations or legal requirements. Users will be notified of material changes. Continued use of the platform after changes constitutes acceptance of the revised Terms.

This Agreement, read together with the Privacy Policy and any other applicable policies or disclaimers referenced herein or available on the Expert-Ease Platform, constitutes the complete and exclusive understanding and agreement between you and the Company with respect to your access to and use of the Platform. It supersedes all prior or contemporaneous communications, representations, agreements, or understandings, whether oral or written, relating to the subject matter herein.

15. Disclaimer of Warranties and Limitation of Liability

The content made available on the Expert-Ease Platform may, from time to time, contain typographical errors, inaccuracies, or omissions resulting from human or technical errors. Such content may be modified, corrected, or updated at any time, at the sole discretion of Expert-Ease, without prior notice. Expert-Ease makes no warranties or representations, express or implied, regarding the accuracy, reliability, suitability, or completeness of the content, information, or features available on the Platform for any specific purpose.

UNDER NO CIRCUMSTANCES SHALL EXPERT-EASE, INCLUDING ITS DIRECTORS, EMPLOYEES, REPRESENTATIVES, OR AGENTS, BE LIABLE TO ANY USER OR THIRD PARTY FOR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF USE, DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE PLATFORM, OR ANY LINKED WEBSITE, EVEN IF EXPERT-EASE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

FURTHERMORE, EXPERT-EASE DISCLAIMS ANY AND ALL LIABILITY FOR THIRD-PARTY PRODUCTS OR SERVICES OFFERED THROUGH THE PLATFORM, AS WELL AS FOR ANY COMMERCIAL TRANSACTIONS FACILITATED THROUGH THE PLATFORM, INCLUDING BUT NOT LIMITED TO THE PROCESSING OF PAYMENTS OR DELIVERY OF SERVICES.
